Challenging Western Legal Orientalism

Abstract In 2014 the Chinese State Council announced establishment of a nationwide comprehensive social credit system. Western narratives often describe initiative as technologically enhanced tool autocratic control for scoring people. Yet, paper aims to show, similar accounts are tainted by several misunderstandings which perpetuate orientalist postures towards law. For purpose comparatively assessing system, analyses pilot programs set up monitor people and enterprises’ behaviour twenty-eight cities. The analysis will demonstrate that these rely on low-tech methodologies, have limited strings attached, based relatively transparent legal framework. From comparative perspective, our findings suggest cities’ experiments raise problems those posed measurement practices widely employed in West.
